1. Acceptance of Terms

By accessing or using SmartGPAssist ("the Service"), operated by Dr Sudheer Talari ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SmartGPAssist is an AI-powered documentation and decision-support tool designed for Australian general practitioners, GP registrars, nurse practitioners, and medical educators. The Service provides:

  • Consultation recording and transcription
  • AI-generated clinical analysis and documentation
  • MBS billing suggestions and maximisation
  • RACGP screening reminders
  • RCPA pathology test recommendations
  • AHPRA complaint risk assessment
  • Referral letters, medical certificates, and patient handouts
  • Drug interaction checking
  • CPD audit tracking

3. Medical Disclaimer

IMPORTANT — PLEASE READ CAREFULLY

SmartGPAssist is a documentation and decision-support tool only. It does NOT provide clinical diagnoses, treatment recommendations, or medical advice. All AI-generated content — including billing suggestions, screening reminders, pathology recommendations, AHPRA risk assessments, drug interaction checks, and clinical analyses — are informational suggestions only.

The treating medical practitioner retains full clinical responsibility for all patient care decisions, prescribing, investigations, referrals, and documentation. You must exercise independent clinical judgement at all times and verify all AI-generated suggestions before acting on them.

SmartGPAssist does not replace professional medical education, clinical guidelines, or consultation with specialist colleagues. The AHPRA complaint risk assessment does not constitute legal advice — always consult your medical indemnity provider (e.g., Avant, MIPS, MDA National) for medico-legal matters.

4. Eligibility

The Service is intended for use by registered medical practitioners, medical students, nurse practitioners, and allied health professionals in Australia. By using the Service, you represent that you are a qualified healthcare professional or student and that you will use the Service in accordance with your professional obligations and scope of practice.

5. User Accounts and Credits

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials. Credits are purchased in advance and are non-refundable except as required by Australian Consumer Law. Each consultation uses one credit. Free credits provided at signup are promotional and may be modified or discontinued at our discretion.

6. Patient Data and Consent

You are responsible for obtaining appropriate patient consent before recording any consultation. You must comply with all applicable privacy legislation including the Privacy Act 1988 (Cth), Australian Privacy Principles, and relevant state/territory health records legislation. SmartGPAssist processes audio recordings for transcription and analysis purposes only.

7. Intellectual Property

All content, software, design, branding, and intellectual property associated with SmartGPAssist is owned by Dr Sudheer Talari and is protected by Australian and international copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from any part of the Service without prior written consent.

The clinical frameworks, analysis methodologies, AHPRA risk assessment domains, and billing maximisation algorithms used in SmartGPAssist are proprietary and confidential.

8. Prohibited Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the source code or algorithms
  • Copy, replicate, or create competing products based on SmartGPAssist's features or methodologies
  • Share your account credentials with others
  • Use the Service to generate fraudulent Medicare claims
  • Upload content that violates patient privacy or confidentiality
  • Attempt to circumvent any security measures or access controls

9. Limitation of Liability

To the maximum extent permitted by law, SmartGPAssist and Dr Sudheer Talari shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to clinical outcomes, billing disputes, AHPRA notifications, or any loss of data. Our total liability shall not exceed the amount paid by you for credits in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Dr Sudheer Talari, SmartGPAssist, and its affiliates from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

11. Modifications

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of Australia. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law.
